If you are involved in an accident, you must remain at the scene and provide all possible assistance. Failure to remain refers to leaving the scene of an accident without offering assistance or providing your required information. All drivers involved in an accident must remain at the scene, identify themselves, and provide insurance and vehicle details. Failure to remain is one of the most consequential charges under the Highway Traffic Act.

Police and prosecutors treat failure to remain offences harshly, as they may be seen as an attempt to avoid responsibility.

Penalties & Punishments

Demerit Points

If convicted of failure to remain, you will get 
7 demerit points, which will stay on your record for two years from the date of the offence.

Fines

If convicted of failure to remain, you will be fined a minimum of $400 and a maximum of $2,000.

Jail Time

If convicted of failure to remain, you could face jail time of up to 
6 months.

Loss of Licence

If convicted of failure to remain, your licence could be suspended for up to two years.
