What Is Distracted Driving?

Distracted Driving: Definition

While "distracted driving" isn't actually the name of a charge under the Highway Traffic Act, it’s a term commonly used to refer to the charges given for using a cellphone or any other hand-held communication device, entertainment device, or GPS while driving. For cellphones, in particular, this can include texting, talking, scrolling, or even just holding your phone.

Distracted driving charges apply whether you're moving or stopped at a red light or in traffic. Ontario has some of the strictest distracted driving laws in Canada.

Examples

Holding or using your phone to text, dial, or scroll while driving.
Checking GPS directions on your phone while it’s not properly mounted.
Watching videos or interacting with apps while driving.

Penalties & Punishments

If convicted of one of the offences that falls under the umbrella of "distracted driving", you will get 3 demerit points for your first offence, and 6 demerit points for subsequent offences.

If convicted of distracted driving, you will be fined between $615-$2,000.

If convicted of distracted driving, you will lose your licence for 3 days for a first offence, 7 days for a second offence, and 30 days for subsequent offences.

If convicted of distracted driving, insurance companies may determine you are a high-risk driver, which could lead to higher insurance premiums.
