What Is an Overweight Vehicle?

Overweight Vehicle: Defenition

All commercial motor vehicles (CMVs) are subject to maximum weight limits. A vehicle is considered overweight if it exceeds any of its permitted weight thresholds, based on its permit, configuration, or route. The offence applies to trucks, trailers, combinations, and buses. Charges may apply even if the driver was unaware of the overload, and both the driver and the operator are held responsible. Penalties can escalate sharply with the degree of the weight violation.

Exceeding gross vehicle weight, which is the total weight including the vehicle itself and its cargo.
Exceeding axle weight limits, which is when the weight distributed to a single axle or a group of axles is over the allowed limits.
Operating an overweight vehicle without the required oversize or overweight permits.
Violating permit conditions for a specific weight or size.
Ignoring seasonal weight restrictions when certain roads have load restrictions due to road conditions.

Penalties & Punishments

If convicted of operating an overweight vehicle, the operator will receive 3-5 CVOR points.

If convicted of operating an overweight vehicle, the driver will be fined at different rates depending on the amount of kilograms the vehicle is found to be overweight.

If convicted of operating an overweight vehicle, insurance companies may determine you are a high-risk operator, which could lead to higher insurance premiums.

If consistently convicted of operating an overweight vehicle, the continued violations may trigger a safety rating downgrade.
