Commercial drivers must complete a Daily Vehicle Inspection Report (DVIR) before operating their vehicle. If the driver identifies a minor defect, they are still legally allowed to operate the vehicle, but only if the defect is noted on the DVIR and does not compromise safety. However, if a vehicle is operated with a minor defect that’s not reported, or with a minor defect that becomes more serious, the driver can be charged and the offence will impact the operator’s CVOR.

Penalties & Punishments

If convicted of driving a CMV with a minor defect, the operator will receive 1 CVOR point.

If convicted of driving a CMV with a minor defect, the driver will be fined $200.

If consistently convicted of driving a CMV with a minor defect, the continued violations may trigger a safety rating downgrade.

If consistently convicted with offences of this nature, it will affect the company’s safety rating and could trigger a MTO audit.
